Teacher Transgender Scandal Continues
In Batavia City School, New York

A Challenge To The School District

Debra J.M. Smith, October 9, 2006

Does there come much worse of a scandal than a public school in America subjecting children to a sexually ill male teacher dressing as a woman? Batavia, NY City School District is doing just that. Many parents and children are being grossly misled, as to why.

Batavia’s city school superintendent, Richard Stutzman has numerous times implied that his hands are tied. The message people are receiving from him is that the teacher has been diagnosed with a medical disorder, and that it is against NY law to discriminate against those with medical disorders. People are to believe that relieving the teacher of his job (obtained before this “diagnosis”) would be illegal. I challenge that.

Pedophilia: Also defined as a “Disorder”

I challenge the belief that Batavia schools cannot terminate the science teacher’s employment. If they cannot let him go, on the grounds of such being discrimination against a person with a disorder, would they also keep in their employment a pedophile?

The same publication (DSM-IV) that defines a man wanting to be a woman as a gender “disorder” also defines pedophilia to be such. According to CSEC Home Page - Child pornography: an international perspective:

The American Psychiatric Association defines pedophilia as a disorder in which an adult's primary sexual attraction is to prepubescent children, generally age 13 and under. American Psychiatric Association, Diagnostic and Statistical Manual of Mental Disorders: DSM-IV 527-28 (1994).

Other Disorders As Per The DSM-IV

Shall Batavia schools be opened up all of these?

  • Exhibitionism: the recurrent urge or behavior to expose one's genitals to an unsuspecting person.
  • Fetishism: the use of non-sexual or nonliving objects or part of a person's body to gain sexual excitement. Partialism refers to fetishes specifically involving nonsexual parts of the body.
  • Frotteurism: the recurrent urges or behavior of touching or rubbing against a nonconsenting person.
  • Masochism: the recurrent urge or behavior of wanting to be humiliated, beaten, bound, or otherwise made to suffer.
  • Chronophilias such as Infantophilia: the sexual attraction to infants, Pedophilia: the sexual attraction to prepubescent children, Ephebophilia/Hepephilia: the sexual attraction to pubescent children, Gerontophilia: the sexual attraction to the elderly, and teleiophilia the sexual attraction of children to adults.
  • Sadism: the recurrent urge or behavior involving acts in which the pain or humiliation of the victim is sexually exciting.
  • Transvestic fetishism: a sexual attraction towards the clothing of the opposite gender.
  • Voyeurism: the recurrent urge or behavior to observe an unsuspecting person who is naked, disrobing or engaging in sexual activities.

I spoke with a gentleman who works with the NYS Department of Education in the area that is set up to prevent child abuse in NY schools. The man I spoke with agreed with me that there are disorders that New York State would not allow a person to continue teaching with, after diagnosed.

(The same man from the state ran down a list of what is seen as child abuse, and one of the things he said was intimidation of students.)

Conditioning of Children

Every time I hear of yet another student being ‘okay’ with having this science teacher, I think about what a man from Monroe County’s Life Line told me over the phone about pedophilias. He told me that they condition the children. This conditioning makes a child go along with that, which an unconditioned child would not easily go along with.

We also need to keep in mind that children will often applaud that, which is bad. It is up to mentally stable adults to regulate what happens in a child’s world. What some children may think is ‘cool’ in their adolescent years, they may see as abuse and neglect, as adults looking back on those years. Then the domino effect could be endless for some.

Does New York State Recognize This Man As Woman?
Are children having to except what the state does not?

If New York State (NYS) is really the reason this school district cannot remove the science teacher from their school, then NYS needs to answer these questions.

1)   If NYS sees this man as a woman, then will NYS no longer see him as married to the mother of his children? NYS does not allow same-sex marriage.

2)   Does NYS no longer let this man file, “Married Filing Jointly” on his tax return?

3)   Has his name been removed from NYS records as his children’s legal “father?” This should include birth certificates and school records.

4)   Does NYS allow Batavia schools to list this man as a woman now on employment records?Does the NYS Department of Education now recognize him as a woman?

5)   Does NYS Department of Motor Vehicles now list this man as a woman on his driver’s license?

6)   Does NYS force this man’s life insurance company to carry him as a woman, which costs less? Will NYS force this man’s health insurance to list him as female?

7)   If this man is summoned to serve on a Jury or testify at a trial, will NYS allow him to claim to be a woman under the penalty of perjury? Will NYS even allow him to serve on a jury, as a woman and or with this "disorder"?

8)   Does NYS not allow police and judges to know this person is genetically a man?

9)   Would NYS allow this man, as a woman, to marry a man?

Other Questions Needing Answered

1)   If he joined the military would he be with the men or the women?

2)   Has The Office of Social Security allowed him to change his identity to that of a woman? Employers need a Social Security number in order to legally pay him. Also, when he goes to collect Social Security, will he collect it as a female? There are some gender specific codes that can get applied when a person collects social security, would such be altered for him?

3)   Does the IRS consider him a woman now?

4)   Is he now allowed in woman’s washrooms out in public?

5)   Would a woman’s shelter be forced to let him in, in order to get state aid?

6)   Would girl scouts be seen as discriminating if they do not let him lead a troop?

7)   Is he protected from a law suit by another man, if a sexual relationship was started without prior notice of him genetically being a man?

8)   If he previously held any of the following job titles in Batavia schools, would such be allowed?

School Nurse?

Guidance Counselor?

Kindergarten Teacher?
School Psychologist?

If New York State does not recognize this man as a woman, then NYS cannot be blamed.
Did Batavia School superintendent, Richard Stutzman inject his own will on the students?

The US Government does not see him as a woman either. His Social Security Number
will continue to have 'man' next to it. That means that he is paid as a man.

Please Note: At the time of writing this article, the name of the teacher is unknown to me, which is what I prefer. The issue is not about him personally, but the situation itself. (Up-date 10/10/06 - I have since learned the name of this man, but it does not mean a thing to me, as it is just a name.)
