                                Appeals Court Strikes Health Insurance Requirement - But What's The Real Fight

From the article: "The Justice Department countered that Congress had the power to require most people to buy health insurance or face tax penalties because Congress has the authority to regulate interstate business."

How can anyone believe the "Commerce Clause" gives the federal government the right to take over an industry of any type? --Here is the power that the Commerce Clause gives congress: To regulate commerce with foreign nations, and among the several states, and with the Indian tribes.

"Commerce" is the buying and selling of goods. Congress is given the power to "regulate" the buying and selling of goods "with foreign nations, and among the several states, and with the Indian tribes." In no way does this give congress the power to take over the industries, entities, or individuals, buying and selling the goods. Congress simply has the power to "regulate" the buying and selling of goods "with foreign nations, and among the several states, and with the Indian tribes." --This is ONLY the "buying and selling," NOTHING more. Congress cannot regulate how the industries are ran or force people to do business with the industries.

And here is another fact; the commerce clause does NOT give congress any power over commerce (buying and selling) IN STATE. --Meaning, congress cannot regulate the buying the selling between companies, entities, and or individuals, within individual states. The trading has to take place with another country, another state, or an Indian Tribe. This means that congress has NO right to regulate, even the trade of health insurance (with the exception of what health insurance is sold to Indian Tribes), because health insurance currently cannot be sold across state lines.

That's right; health insurance cannot be sold across state lines. So the buying and selling (commerce) of health insurance between instate entities cannot be regulated by congress. And THAT is what the big health-care-law fight in the courts should be about
